Fifth suspect in La Bamba incident pleads not guilty

Judge Mitch Shick denied a motion to lower the bond for William A. Graham, 31, the fifth suspect to face a litany of charges stemming from an angry mob scene.

Graham waived his preliminary hearing and plead not guilty to mob action and threatening a peace officer in an incident the prosecution called a “melee” outside La Bamba Mexican Restaurant in the early hours of Sept. 27.

Graham’s bond was set at $100,000, but Shick wouldn’t lower it because of Graham’s previous domestic battery and controlled substance convictions. His defender, Tuscola attorney Jeanine Garrett, said Graham had successfully completed all his sentences and kept a job at a janitorial company.

Graham is accused of threatening police and civilians at the mob scene, saying “Bring your dogs and guns. I’ve got bigger ones than that,” and gesturing toward his car.

Graham’s case will go to a jury trial Nov. 17.

The four other suspects are Seniece A. Graham, 28, charged with aggravated battery to a police officer; Jacques M. Spence, 24, charged with aggravated battery and resisting a peace officer; Charles L. Spence, 32, charged with aggravated battery in a public place; and Lee E. Graham, 36, charged with aggravated battery, obstructing a peace officer and resisting arrest.

Their jury trials are also set for Nov. 17.
