Students accused in shooting face status hearing

Details of the jury trial for a defendant in the Oct. 24 shooting into a 12th Street residence may be decided in court Monday.

The status hearing for Marc D. Griffin, 21, Chicago, is scheduled for 11 a.m. at the Coles County Circuit Courthouse on the Square, an employee at the circuit clerk’s office said.

Griffin is being charged with aggravated discharge of a firearm for shooting into the 1514 12th St. home where seven people were present.

“What I anticipate happening is that a date will be set for a hearing on some motions that have been filed,” Assistant State’s Attorney Duane Deters said Jan. 29 in an e-mail. “We may also set a trial date at that time; however, that is uncertain.”

Crystal P. Lovemore, 19, a sophomore undeclared major, 1151 Johnson Ave., also is being charged for her involvement in the shooting.

Motions filed for Griffin’s case include a motion for discovery and a motion for joinder to connect Griffin’s and Lovemore’s cases.

During the Dec. 1 preliminary hearing, Coles County Circuit Court Judge Mitch Shick ruled probable cause in both cases and defense attorneys submitted not guilty pleas for each client and requested jury trials.

Shick ruled the prosecution’s witness, Detective Kevin Paddock, supplied enough information to establish burden of proof.

He also ruled Lovemore was accountable for the shooting despite her attorney David Stevens’ questioning that there was “no evidence Lovemore aided, agreed or attempted aid.”

Deters said Lovemore’s threat, involvement in an on-campus fight before the shooting and her presence in Griffin’s vehicle at the time of arrest, was enough to determine probable cause.

Paddock testified at the hearing that witnesses on the scene identified Lovemore and Griffin as being on the 12th Street property prior to the shooting.

Reports in police documents said Lovemore was sexually involved with a resident in the 12th Street home, Amral L. Johnson, a junior sociology major and Panther football player, prior to the shooting.

Johnson told police he fought with Lovemore days before the shooting, and Lovemore said she had a boyfriend with a gun and she “can have him killed.”

Reports said Griffin and Lovemore then attended the First Annual Johnetta Jones Memorial Homecoming Step Show where Griffin and Johnson were involved in a fight.

Occupants of the 12th Street residence told police that nearly an hour later Griffin, Lovemore and Griffin’s gold colored 2000 Dodge Intrepid were seen in the alley behind the home.

Kyle E. Hill, former Eastern basketball player and Bolingbrook resident, and Johnson told police Griffin then tapped on the window and said, “Do you want to gun play?”

Occupants told police they turned off the lights, heard several shots fired and called police.

Griffin and Lovemore were then apprehended by police at in the parking lot of Domino’s Pizza at Seventh Street and Lincoln Avenue. The occupants were taken to Domino’s by police, where they identified Griffin and Lovemore.

Motions to dismiss charges, suppress identification, suppress evidence and suppress statements were filed by Stevens.

Stevens also filed motions for discovery, trial setting and joinder for Lovemore’s case.

The status hearing date for Lovemore was set in December for Feb. 2 to correlate her case with Griffin’s, but circuit court records show her next hearing date set for Feb. 20 at 11 a.m.
